TERMS OF USE

Focus Arena  Effective Date: April 19, 2026

1. Acceptance of Terms

By downloading, installing, or using the Focus arena application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not access or use the App. These Terms constitute a legally binding agreement between you ("User") and Focus Arena ("Company").

2. License to Use (EULA)

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial study and productivity purposes. This license does not include any right to:

Apple EULA: This license is subject to the Apple Standard Licensed Application End User License Agreement (EULA), which is incorporated herein by reference. In the event of a conflict between these Terms and the Apple Standard EULA, the terms of the Apple Standard EULA shall prevail.

• Copy, modify, or distribute the App or its content
• Reverse engineer, decompile, or disassemble any part of the App
• Create derivative works based on the App
• Use the App for any commercial purpose without our written consent

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized access to your account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscription & In-App Purchases

Focus arena offers optional premium features through a subscription model ("Prime Focus"). All purchases are processed through Apple App Store and are subject to Apple's Terms of Sale. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Refunds are governed exclusively by Apple's refund policy.

5. Prohibited Conduct

You agree not to:

• Use the App in any manner that violates applicable local, national, or international laws or regulations
• Attempt to gain unauthorized access to our systems or other users' accounts
• Engage in any activity that disrupts, damages, or interferes with the App's functionality
• Upload or transmit any malicious code, viruses, or harmful software
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Use automated systems (bots, scrapers, or similar tools) to access the App

6. Intellectual Property — NOTICE OF LEGAL PROTECTION

All intellectual property contained within or associated with the Focus Arena application — including but not limited to the application's source code, user interface design, visual assets, graphic elements, color schemes, typography, layouts, branding, logo, trade name, feature concepts, animations, and any other creative work — is the exclusive property of Focus Arena and is protected under applicable copyright, trade dress, trademark, and unfair competition laws.

Any unauthorized reproduction, imitation, copying, distribution, modification, reverse engineering, or commercial exploitation of any part of this application's design, code, or intellectual property — whether in full or in part — is strictly prohibited and constitutes a serious infringement of our legal rights.

Violations will be met with immediate and aggressive legal action, including:

• Civil litigation seeking maximum statutory and actual damages
• Emergency injunctive relief to immediately halt infringing activity
• Full recovery of all legal costs, attorney's fees, and investigative expenses
• Criminal referral where applicable under copyright and computer fraud laws

We actively monitor markets, app stores, and online platforms for potential infringement. Any individual, company, or entity found to be reproducing or imitating the design, functionality, or code of Focus Arena will be prosecuted to the fullest extent of the law without prior warning.

7. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. Your use of the App is entirely at your own risk.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Focus Arena shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, even if we have been advised of the possibility of such damages.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Turkey, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Turkey.

10. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes become effective upon posting the updated Terms in the App or on our website. Your continued use of the App after changes are posted constitutes your acceptance of the new Terms.
